OJTBF understands the importance of protecting personal information under its control, and is committed to collecting, using and disclosing personal information responsibly.

OJTBF’s Privacy Policy references relevant principles included in the Federal Personal Information Protection and Electronic Documents Act (“PIPEDA“). These guiding principles ensure safeguards are in place when managing the collection, use, disclosure, retention, and ultimate disposal of personal information in OJTBF’s control.

This Policy applies to personal information held by OJTBF concerning members, participating employers, former members or other relevant individuals and gives effect to PIPEDA’s ten fair information principles.

Purposes: OJTBF collects, uses and discloses Personal Information for the purpose of marketing and administering group insurance plans, legislative requirements, and other legal obligations.

Consent: Where applicable, OJTBF obtains consent for the collection, use, and disclosure of Personal Information. When Personal Information is collected, used, or disclosed for a purpose other than the identified purposes above, OJTBF documents the new purpose and obtains the individual’s consent. When express consent is required, OJTBF generally uses preprinted forms both to obtain consent and to collect information. OJTBF may also use these forms to advise individuals of the use that will be made of the information; to which types of organizations the information may be transferred or disclosed, if any; and of their right to withdraw their consent, together with the consequences of the withdrawal.

Limiting Collection: OJTBF limits the collection of Personal Information to what is necessary for the purpose identified. OJTBF will ensure that the Personal Information is collected by fair and lawful means.

Limiting Use, Disclosure and Retention: OJTBF uses Personal Information for identified purposes above. OJTBF does not use Personal Information for unrelated purposes unless consent as been provided or OJTBF is permitted or required to do so by law.

OJTBF discloses Personal Information for the identified purposes above. OJTBF does not disclose Personal Information for unrelated purposes unless consent has been provided for such disclosure.

Any Personal Information in the custody or under the control of OJTBF may be disclosed in order to fulfill the identified purpose.

Only OJTBF employees, or third parties retained by OJTBF who require the information to perform duties on behalf of OJTBF, or whose duties reasonably so require, are granted access to Personal Information.

OJTBF retains Personal Information only as long as it remains necessary or relevant for the identified purposes, or as required by law. OJTBF will destroy Personal Information when it is no longer required to fulfill the identified purpose or by law.

Accuracy: OJTBF makes reasonable efforts to ensure that Personal Information is accurate and complete. OJTBF relies on its participants to ensure that certain information is current, complete and accurate. Participants may request correction to their Personal Information in order to ensure its accuracy and completeness.

Security Safeguards: OJTBF protects Personal Information by ensuring security safeguards appropriate to the sensitivity of the information are in place to prevent loss, theft, or any unauthorized access, disclosure, copying, use or modification. Those security safeguards include administrative, technical and physical measures.

Openness: OJTBF has developed and made available their Privacy Policy, which describes its information management practices; provides contact information for the Privacy Officer; explains how to make an access request and how to make a complaint; and describes the type of Personal Information held by OJTBF. Complaints can be made in writing to the Privacy Officer.

Individual Access Requests: Individuals have the right to request access to their Personal Information under the control of OJTBF, and to know how the information has been used, and to whom it has been disclosed. The Privacy Officer will assist them with their access requests. Access requests must be made in writing to the Privacy Officer and will be responded to within 30 days.

Security Breach Reporting: OJTBF maintains a Security Incident Policy. OJTBF will respond to any and all privacy breaches in accordance with the Security Incident Policy.

Compliance: OJTBF shall investigate all reasonable complaints concerning compliance with the Privacy Policy. If a complaint is found to be justified, OJTBF shall take appropriate measures to resolve the complaint including, if necessary, amending its policies and procedures. OJTBF will advise the person making the complaint of the outcome and any steps taken.
